When treaties and concordats have a higher hierarchy than laws in a constitution. This will be Justice, contrary to many countries that are part of conventions, treaties, and international pacts, just being part of a signature on stationery, nothing more. Treaties and concordats have a higher hierarchy than laws.The American Declaration of the Rights and Duties of Man; the Universal Declaration of Human Rights; the American Convention on Human Rights; the International Covenant on Economic, Social and Cultural Rights; the International Covenant on Civil and Political Rights and its Optional Protocol; the Convention on the Prevention and Punishment of the Crime of Genocide; the International Convention on the Elimination of All Forms of Racial Discrimination; the Convention on the Elimination of all Forms of Discrimination against Women; the Convention against Torture and other Cruel, Inhuman or Degrading Treatment or Punishment; the Convention on the Rights of the Child; Under the conditions of their validity, they have constitutional hierarchy, they do not repeal any article of the first part of this Constitution and must be understood as complementary to the rights and guarantees recognized by it. They may only be denounced, if applicable, by the national Executive Branch, with the prior approval of two-thirds of all the members of each Chamber.The other treaties and conventions on human rights, after being approved by Congress, will require the vote of two-thirds of all the members of each Chamber to enjoy constitutional hierarchy.
